Right to Education Is Guaranteed by Law

The DPRK thoroughly guarantees the people’s right to education by law. The Socialist Constitution of the DPRK makes clear the policies for education, including the enforcement of the systems of universal 12-year compulsory education and free education. It also stipulates the citizen’s right to education. This right is ensured by the advanced educational system and by the educational measures enacted by the State for the benefit of the people, and is firmly guaranteed by the education-related laws. Typical of them are the law on the nursing and upbringing of children, the law on education, the law on general education, the law on higher education, etc. Those laws stipulate the detailed problems arising in the efforts to develop education, including consolidation and development of the socialist education system, embodiment of the principles of socialist pedagogy, and combination of education with practice and school education with social education. They also make clear the problems for strengthening the work of nursing and upbringing of children, increasing State investment in the education sector, fully ensuring teaching conditions, intensifying education and scientific research, and protecting the rights of overseas Koreans to democratic national education. Thanks to those laws, all the people in the DPRK are fully provided with the right to receive pre-school education and primary, secondary and higher education free of charge without any discrimination or restriction and the right to study in excellent educational conditions and environments. The Sixth Session of the 12th Supreme People’s Assembly of the DPRK held in September Juche 101 (2012) adopted the law on enforcing the universal 12-year compulsory education. The law serves as a legal guarantee for the rising generation to exercise the right to education on a higher level by enhancing the general secondary education onto a new high stage. The country has provided legal guarantees for making all the people well versed in science and technology and for making them study throughout their life by developing the regular system of higher education and the study-while-you-work higher education system. The Third Session of the 14th Supreme People’s Assembly of the DPRK held in April Juche 109 (2020) adopted the law on distance education in order to fully provide all the working people with the right to receive part-time higher education. The work to build up the ranks of teachers in direct charge of educational work according to a long-term plan and enhance their role is also stipulated by other laws and regulations and are being carried into effect.
